These Terms of Service ("Terms") govern your use of firstgrandpropertymanagement.com (the "Site"), operated by First Grand Property Management Ltd ("First Grand", "we", "us", "our"), a company incorporated in the Republic of Mauritius. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About us
First Grand provides property management and short-term rental operation services in Mauritius, including the guest-facing brand First Grand Stays. The Site provides information about our services and allows you to contact us.
2. Scope of these Terms
These Terms apply to your use of the Site only. They do not create a management, booking or agency relationship.
- Property owners: management services are governed exclusively by a separate written management agreement signed between you and First Grand. If these Terms conflict with your management agreement, the management agreement prevails.
- Guests: bookings made through third-party platforms (for example Airbnb, Booking.com, Agoda, Trip.com) are governed by that platform's terms and the booking conditions shown at the time of reservation, together with any house rules provided for the property. Direct bookings, where offered, are subject to the booking terms provided at the time of booking.
3. Use of the Site
You agree to use the Site lawfully and not to: attempt to gain unauthorised access to the Site or related systems, introduce malware or harmful code, scrape or copy content for commercial purposes without our written consent, or use the Site to send spam or fraudulent enquiries.
4. No financial, investment, legal or tax advice
Nothing on the Site constitutes financial, investment, legal, tax or accounting advice, or a recommendation, solicitation, offer or invitation to purchase any property, security or other investment.
First Grand is a property management company. We are not licensed by the Financial Services Commission of Mauritius as an investment adviser, investment dealer or any other financial services provider, and we do not advise, guide or recommend any person to enter into securities transactions within the meaning of the Securities Act 2005 of Mauritius.
Any rental income projections, occupancy figures, yield estimates, return metrics, case studies or market data published on the Site or provided in an appraisal are illustrative and for general information only. They reflect past performance or estimates based on data available at the time of publication. Past performance is not a guarantee of future results, and actual results may differ materially. You are solely responsible for your own decisions and should obtain independent financial, legal and tax advice from appropriately licensed professionals before making any investment or property decision. To the fullest extent permitted by law, we accept no liability for any decision made in reliance on content published on the Site.
5. Information on the Site
While we take care to keep the Site accurate and up to date, we make no warranty that the content is complete, accurate or error-free.
6. Enquiries and appraisals
Submitting an enquiry or requesting a rental appraisal does not create any obligation on either party. Any appraisal, revenue projection or proposal we provide is indicative only and non-binding until a written agreement is signed.
7. Intellectual property
All content on the Site, including text, branding, logos, photography, reports and design, is owned by or licensed to First Grand and protected by applicable intellectual property laws. You may view and print content for personal, non-commercial use. Any other use requires our prior written consent.
8. Third-party links and platforms
The Site may link to third-party websites and booking platforms. We do not control and are not responsible for their content, terms or privacy practices. Your use of those platforms is at your own risk and subject to their terms.
9. Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Site you acknowledge that you have read it.
10. Limitation of liability
To the fullest extent permitted by law, First Grand shall not be liable for any indirect, incidental, special or consequential loss arising from your use of the Site or reliance on its content, including loss of profit, revenue, data or business opportunity. Nothing in these Terms excludes or limits liability that cannot be excluded under the laws of Mauritius, including liability for fraud.
11. Indemnity
You agree to indemnify First Grand against claims, losses and expenses arising from your breach of these Terms or misuse of the Site.
12. Availability
We may modify, suspend or discontinue the Site or any part of it at any time without notice. We do not guarantee that the Site will be available or uninterrupted.
13. Changes to these Terms
We may update these Terms from time to time. The latest version will be published on this page with the date of the last revision. Continued use of the Site after changes constitutes acceptance.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Mauritius. Any dispute arising from these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Mauritius.
